Warranty

Subject to normal use all our products are guaranteed to the original purchaser (the warranty is not transferable) for a period of 2 years from the date of purchase. The timber parts of our backyard climbing frames are guaranteed to the original purchaser (the warranty is not transferable) for a 10 years period against wood rot caused by fungi that occurred after delivery within the term of the warranty period. The timber parts of our commercial playground equipment are guaranteed to the original purchaser (the warranty is not transferable) for a 5 years period against wood rot caused by fungi that occurred after delivery within the term of the warranty period. Warranty for backyard climbing frames

Manufacturer’s limited warranty

Subject to normal use this product is guaranteed by Jungle Gym®, to the original purchaser for a period of 2 years from date of purchase, on the following conditions:

  • That those defects are attributable to flaws or defects in materials or manufacturing defects.
  • That the directions of both parts 1, 2 and 3 of our instruction manual have been thoroughly observed and followed.
  • That the products only have been used for the construction of playsets for single-family residential purposes.

This limited warranty does not cover:

  • The labour or cost of labour for replacement of the defective item.
  • The cost of freight for replacement part after the initial 30 day period.
  • Any incidental or consequential damages.
  • Items damaged due to vandalism, neglect, improper usage, improper installation, normal wastage, extreme weather conditions or other abnormal conditions.
  • Cosmetic defects that do not affect the structural integrity of the unit.
  • Cases of fading of colours or minor deviations that cannot be technically anticipated or prevented are generally accepted in trade.
  • Any modifications added to components and accessories.


Warranty procedure

Within a 30-day period, Jungle Gym will replace defective merchandise free of charge, provided that the defective part be returned for inspection, freight collect. Jungle Gym will return the part freight prepaid. After the 30-day period, return the defective part freight prepaid and Jungle Gym will ship it back to you freight collect. The place of purchase must be contacted for authorization to return the defective part. No merchandise will be accepted without prior written approval from Jungle Gym. All returns must be accompanied by a dated proof of purchase. In cases when a defective part is returned to Jungle Gym, please ensure that the part is protected against transport damage.

Customer responsibilities

  • It is the customer’s responsibility to perform regular inspections and maintenance to ensure that the product is not prematurely aging. These inspections and maintenance are mentioned in this manual.
  • The customer has to take all precautions to safeguard the safety of the children.

Jungle Gym disclaims all other representations and warranties of any kind, expressed or implied, in fact, or in law, including, without limitation, the implied warranty of merchantability and the implied warranty of fitness for a particular purpose. The statement above does not affect a consumer’s statutory rights. Because some jurisdictions in some countries do not permit the exclusion or limitations set forth above, they may not apply in all cases. Jungle Gym® reserves the right to make changes in materials and design without prior notice.

Additional warranty on the timber parts

Jungle Gym offers, to the initial purchaser, a 10-year warranty on all timber components of the purchased items. This guarantee includes damage caused by wood rot or fungi that occur after delivery and within the warranty period. The warranty is no longer valid if the purchaser, or a third party, causes damage to the timber of the playground set due to incorrect assembly, improper use, improper maintenance, or vandalism. Damage caused by extreme weather events (e.g storm damage), or the normal wastage of timber, are also not covered. The warranty period commences on the date the purchaser receives their playground set. In order to claim their warranty, the buyer must send photos of the damaged timber parts, as well as a copy of the corresponding invoice, or article number with the date of purchase, by mail or email, to Jungle Gym. In a successful warranty claim, the buyer is entitled to either identical or comparable (as decided by Jungle Gym) timber parts, including delivery.

Assembly and disassembly are not covered by the warranty. Reimbursement and/or compensation of expenses are not covered by this guarantee. In order to make a warranty claim, please fill the form.

If a warranty claim is rejected, Jungle Gym reserves the right to charge the customer for the cost of processing the warranty. The legal rights of the consumer (warranty rights and the right of withdrawal) are not limited by the warranty.

Warranty for commercial playgrounds

Manufacturer’s limited warranty

Hy-land guarantees that the delivered parts have been correctly manufactured. If a customer can justify improper manufacturing and possesses a dated proof of purchase, we will examine the condition of the part and replace defective parts within 30 days of acknowledgment of improper fabrication. Hy-land will replace the part free of charge, provided that the defective part is returned for inspection, freight collect and we will return the part freight prepaid.

Following the 30-day period, return the defective part freight prepaid and we will ship this back, freight collect. The buyer should contact the place of purchase for an authorization number in order to return the defective part.

Without the Hy-land authorization number and a dated proof of purchase, we cannot accept any merchandise. The buyer agrees that the warranty is effective for a period of 2 years from the date of purchase, subject to normal use.

Hy-land shall assume liability under this warranty in the following instances:

The defects are attributable to flaws or defects in materials or in the event of manufacturing defects.
The directions in this owner manual have been correctly observed and followed.
The buyer can give evidence of execution of regular maintenance work.
The buyer shall be liable under this warranty if:

Regular inspections and maintenance are performed (recorded in the logbook that is provided) to ensure that the product is not ageing pre- maturely.
All precautions are taken to safeguard the safety of the children.

In the event of vandalism, neglect, improper use, improper installation, normal wastage, extreme weather conditions, incidental or consequential damage, any modifications added to components, or other abnormal conditions, this limited warranty will not cover the replacement of parts or cost of labor.

As some jurisdictions in some countries do not permit the exclusion of liability based on the aforementioned limitations, these may not apply in all cases. The statement above does not affect the buyer’s statutory rights.
